objetivos muito parecidos. Elas visam maior controle e transpar\u00eancia no uso de dados pessoais por parte de empresas e organiza\u00e7\u00f5es.<\/p><p>Neste contexto, LGPD e GDPR determinam como as empresas devem tratar tais dados, quais direitos os propriet\u00e1rios das informa\u00e7\u00f5es t\u00eam e quais penalidades se aplicam se as regras forem violadas.<\/p><p>A GDPR \u00e9 a irm\u00e3 mais velha da LGPD. \u00c9 uma lei que abrange a Uni\u00e3o Europeia e foi implementada em 2018. A GDPR \u00e9 considerada uma refer\u00eancia, uma das leis mais abrangentes e completas quando se trata de privacidade e seguran\u00e7a de dados. Por outro lado, a LGPD \u00e9 a lei brasileira que foi criada com base na legisla\u00e7\u00e3o europeia. Mas ela entrar\u00e1 em vigor apenas no segundo semestre de 2020.<\/p><p>Embora as duas leis tenham finalidades parecidas, h\u00e1 pontos importantes e algumas diferen\u00e7as entre elas que merecem ser destacados. Segundo a GDPR (Artigo 4) e a LGPD (Artigo 5), dados pessoais s\u00e3o quaisquer informa\u00e7\u00f5es relacionadas a uma pessoa identificada ou identific\u00e1vel.<\/p><p>No entanto, h\u00e1 um tipo de dado pessoal que \u00e9 diferenciado pelas leis, como, por exemplo, origem racial ou \u00e9tnica, cren\u00e7a religiosa e opini\u00e3o pol\u00edtica. Este tipo de dado \u00e9 chamado pela GDPR de \u201ccategoria especial de dado pessoal\u201d (Artigo 9) e pela LGPD de \u201cdado pessoal sens\u00edvel\u201d (Artigo 5).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-500c034 elementor-widget elementor-widget-heading\" data-id=\"500c034\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Tratamento de dados pessoais<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-70a0f82 elementor-widget elementor-widget-text-editor\" data-id=\"70a0f82\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Em rela\u00e7\u00e3o ao tratamento e processamento de dados pessoais, a LGPD \u00e9 uma lei mais espec\u00edfica do que a GDPR. De acordo com a lei europeia (Artigo 6), h\u00e1 6 casos em que o processamento de dados \u00e9 permitido: consentimento do propriet\u00e1rio, execu\u00e7\u00e3o contratual, compliance ou conformidade, interesse vital, interesse p\u00fablico e interesse leg\u00edtimo.<\/p><p>J\u00e1 a lei brasileira aponta 10 casos (Artigo 7), acrescentando \u00e0 lista estudos de \u00f3rg\u00e3os e ag\u00eancias de pesquisa, exerc\u00edcio regular de direitos em processos judiciais, prote\u00e7\u00e3o ao cr\u00e9dito e prote\u00e7\u00e3o \u00e0 sa\u00fade.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76746af elementor-widget elementor-widget-heading\" data-id=\"76746af\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">3. Tratamento de dados sens\u00edveis ou especiais<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-568a8fd elementor-widget elementor-widget-text-editor\" data-id=\"568a8fd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Sobre o tratamento de dados sens\u00edveis, a lei brasileira estabelece que esse tipo de dado pode ser processado pelas empresas desde que haja consentimento do propriet\u00e1rio ou titular das informa\u00e7\u00f5es ou em 7 casos espec\u00edficos, como por exemplo, o cumprimento de obriga\u00e7\u00f5es legais e a prote\u00e7\u00e3o \u00e0 vida (Artigo 11).<\/p><p>Neste caso, a GDPR \u00e9 mais incisiva e pro\u00edbe o tratamento de dados sens\u00edveis ou especiais, determinando 10 exce\u00e7\u00f5es, como, por exemplo, para dados que j\u00e1 foram tornados p\u00fablicos pelo propriet\u00e1rio e obriga\u00e7\u00f5es legais (Artigo 9).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f81aeba elementor-widget elementor-widget-heading\" data-id=\"f81aeba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">4. Dados de crian\u00e7as e adolescentes<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a420069 elementor-widget elementor-widget-text-editor\" data-id=\"a420069\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>O processamento de dados pessoais envolvendo crian\u00e7as e adolescentes difere entre as duas leis. Segundo a LGPD (Artigo 14), qualquer pessoa menor de 18 anos deve ter o consentimento de um representante legal. Enquanto isso, de acordo com a lei europeia, a idade m\u00ednima \u00e9 de 16 anos (Artigo 8).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ec0090 elementor-widget elementor-widget-heading\" data-id=\"7ec0090\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">5. Direito de acesso \u00e0 informa\u00e7\u00e3o e prote\u00e7\u00e3o de dados<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8eaa208 elementor-widget elementor-widget-text-editor\" data-id=\"8eaa208\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Ambas as leis determinam que os <a href=\"https:\/\/gatefy.com\/pt-br\/blog\/direitos-titulares-dados-garantidos-LGPD\/\" target=\"_blank\" rel=\"noopener\">propriet\u00e1rios das informa\u00e7\u00f5es t\u00eam direito de controlar os seus pr\u00f3prios dados<\/a> (LGDP: Artigo 18, GDPR: Artigo 12). Na pr\u00e1tica, eles podem solicitar acesso aos dados, portabilidade, corre\u00e7\u00e3o e at\u00e9 exclus\u00e3o. No geral, as empresas devem prestar esse servi\u00e7o gratuitamente.<\/p><p>A LGPD diz que as empresas t\u00eam 15 dias para responder a uma solicita\u00e7\u00e3o de acesso. Por outro lado, a GDPR estipula que o prazo \u00e9 de 30 dias. A lei europeia estabelece ainda que, em casos excessivos, as empresas podem cobrar pela solicita\u00e7\u00e3o, levando em conta custos administrativos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7845833 elementor-widget elementor-widget-heading\" data-id=\"7845833\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">6. Quem s\u00e3o os atores<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-baac538 elementor-widget elementor-widget-text-editor\" data-id=\"baac538\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Tanto a GDPR quanto a LGPD t\u00eam atores que s\u00e3o pessoas, empresas ou organiza\u00e7\u00f5es envolvidas em todo esse processo de <a href=\"https:\/\/gatefy.com\/pt-br\/blog\/lgpd-afeta-email-empresa\/\" target=\"_blank\" rel=\"noopener\">tratamento e seguran\u00e7a de informa\u00e7\u00f5es e dados<\/a> (LGDP: Artigo 5, GDPR: Artigos 4 e 37).<\/p><p>Basicamente, existem 4 atores: o propriet\u00e1rio dos dados ou titular, o controlador, o operador ou processador e o encarregado ou Data Protection Officer (DPO).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3acfb75 elementor-widget elementor-widget-heading\" data-id=\"3acfb75\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">7. Encarregado dos dados ou DPO<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5abf851 elementor-widget elementor-widget-text-editor\" data-id=\"5abf851\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u00a0Sob a GDPR, somentem empresas que trabalham com processamento de dados em larga escala s\u00e3o obrigadas a nomear um DPO (artigo 37). J\u00e1 no caso da LGPD a lei \u00e9 mais abrangente e diz que as empresas precisam definir um DPO.<\/p><p>No entanto, a lei brasileira afirma que a autoridade respons\u00e1vel pode editar normas que dispensem a fun\u00e7\u00e3o de DPO dependendo do tamanho da empresa ou do volume de dados processados (Artigo 41).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-987f533 elementor-widget elementor-widget-heading\" data-id=\"987f533\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">8. V\u00ednculo entre o controlador e o operador<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7162c7d elementor-widget elementor-widget-text-editor\" data-id=\"7162c7d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A GDPR exige um contrato ou um v\u00ednculo jur\u00eddico entre o controlador e o operador, que \u00e9 o respons\u00e1vel pelo tratamento dos dados (Artigo 28). A lei brasileira n\u00e3o faz tal exig\u00eancia, apenas afirmando que o operador deve realizar o tratamento das informa\u00e7\u00f5es segundo as instru\u00e7\u00f5es do controlador (Artigo 39).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7d724a9 elementor-widget elementor-widget-heading\" data-id=\"7d724a9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">9. Escopo territorial<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c2814f4 elementor-widget elementor-widget-text-editor\" data-id=\"c2814f4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A LGPD e a GDPR se aplicam basicamente a quaisquer empresas e organiza\u00e7\u00f5es que operam, respectivamente, no Brasil (Artigo 3) e na Uni\u00e3o Europeia (Artigo 3). O lugar onde essas empresas est\u00e3o sediadas n\u00e3o importa.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-caa18fa elementor-widget elementor-widget-heading\" data-id=\"caa18fa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">10. Multas por descumprimento da lei<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe9a4e4 elementor-widget elementor-widget-text-editor\" data-id=\"fe9a4e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A multa da LGPD \u00e9 de at\u00e9 2% da receita da empresa no ano anterior, limitada a R$ 50 milh\u00f5es (aproximadamente EUR 11 milh\u00f5es) por infra\u00e7\u00e3o (Artigo 52). J\u00e1 a GDPR limita as multas em EUR 20 milh\u00f5es ou at\u00e9 4% do volume de neg\u00f3cios da empresa no ano anterior (Artigo 83).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-865a6c9 elementor-widget elementor-widget-heading\" data-id=\"865a6c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">11. Responsabiliza\u00e7\u00e3o do controlador e do operador<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-196d3b2 elementor-widget elementor-widget-text-editor\" data-id=\"196d3b2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Em caso de problemas, segundo a GDPR, multas e san\u00e7\u00f5es n\u00e3o se aplicam ao controlador e processador se eles provarem que est\u00e3o em conformidade com a lei ou que n\u00e3o s\u00e3o os respons\u00e1veis pelo evento que deu origem ao dano (Artigo 82).<\/p><p>No caso da LGPD, foi acrescentada uma terceira cl\u00e1usula (Artigo 43). Se o dano \u00e9 decorrente de culpa exclusiva do propriet\u00e1rio dos dados, o controlador e o processador est\u00e3o absolvidos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-00dd738 elementor-widget elementor-widget-heading\" data-id=\"00dd738\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">12. Incidentes de seguran\u00e7a e vazamentos de dados<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c21a51c elementor-widget elementor-widget-text-editor\" data-id=\"c21a51c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A LGPD e a GDPR s\u00e3o bastante expl\u00edcitas quando o assunto s\u00e3o incidentes de seguran\u00e7a. Caso um vazamento ocorra, a GDPR diz que as empresas devem notificar a autoridade competente dentro do prazo de 72 horas (Artigo 33).<\/p><p>A LGPD n\u00e3o estipula um prazo mas determina que, al\u00e9m da autoridade, os titulares dos dados tamb\u00e9m devem ser notificados (Artigo 48).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55694ef elementor-widget elementor-widget-heading\" data-id=\"55694ef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">13.
